Clayton police chief who replaced chief charged with DUI charged with same offense

The Clayton Chief of Police has been charged with driving under the influence after he replaced a former police chief who also was charged with driving under the influence.

Chief Carl Hutson was pulled over in the area of Walnut and Front streets in Milford around 11:30 p.m. Friday, Jan. 3, according to the police complaint. The 49-year-old Frederica resident’s blood alcohol concentration was 0.176%, the complaint says. In Delaware, a BAC of 0.08% or higher is sufficient for a DUI conviction, the Division of Motor Vehicles website says.

Hutson was promoted from lieutenant to chief after former Clayton Police Chief Brian Hill was charged with DUI in 2017 and eventually resigned.

Clayton Mayor Nick Smith said in a statement Wednesday the town was “recently informed of a personnel matter involving the Chief of Police.”

“As a government, we prioritize integrity, professionalism, and integrity in all aspects of our operations,” Smith said. “However, to ensure a fair process, we are unable to provide specific details of the incident at this time.”

He did not say whether Hutson is still employed.

Hutson is scheduled to appear at a Justice of the Peace court on Friday, Jan. 17.
