Dec. 19—MITCHELL — The following cases were among those heard Tuesday, Dec. 17, during a circuit court session at the Davison County Public Safety Center, with Judge Chris Giles presiding:
* Mark Gauvin, 44, of Leeds, New York, pleaded guilty to possession of a controlled substance (Ritalin), a Class 5 felony. Gauvin was sentenced to two years of probation and ordered to pay a $750 fine. He received credit for one day served. As part of a plea agreement, several additional charges were dismissed, including possession of drug paraphernalia and possession of two ounces of marijuana, both Class 1 misdemeanors, as well as four additional counts of possession of controlled substances involving THC pills and oil, Vicodin, Adderall and methamphetamine.
* Angel Brown, 30, of Mitchell, appeared in court to request a continuance. Judge Giles rescheduled Brown’s jury trial from February to March. Brown is facing multiple drug-related charges, including conspiracy to distribute cocaine, two counts of distribution of cocaine, and distribution of cocaine in a drug-free zone, all Class 4 felonies. Each of these charges carries a maximum penalty of 10 years in prison and a $20,000 fine. In addition, Brown faces Class 5 felony charges for possession of cocaine, unauthorized ingestion of cocaine, and keeping a place for use or sale of cocaine. Each of these charges is punishable by up to five years in prison and a $10,000 fine. If convicted on all counts, Brown could face a maximum of 55 years in prison, with a mandatory minimum sentence of seven years. Brown pleaded not guilty to all charges back in September.
* Dominic Northrup, 27, of Mitchell pleaded guilty to a third-offense driving under the influence (DUI) charge, a Class 6 felony. His sentencing included a two-year prison term with all time suspended, 16 days in county jail with a six-day credit, a $650 fine and a one-year driver’s license revocation. Northrup was also placed on two years of probation. As part of a plea deal, several charges were dismissed, including resisting an officer, failure to maintain financial responsibility, and having an open alcoholic beverage container, all Class 2 misdemeanors, as well as driving with a revoked license and obstructing police, both Class 1 misdemeanors.
* Brayan Duran-Escobar, 19, of Mitchell, failed to appear in court for a bond forfeiture hearing related to a fourth-degree rape charge. The charges involve a victim between the ages of 13 and 16 and is classified as a Class 3 felony. Judge Giles granted the return of the bond during the hearing.
* Cody Overweg, 24, of Mitchell, pleaded not guilty to charges of domestic abuse/simple assault, a Class 1 misdemeanor, and a third-offense domestic abuse/simple assault charge, a Class 6 felony. A request for a bond modification was denied. A jury trial is scheduled for March.
* Sara Kleinsasser, 30, of Mitchell, appeared in court to face charges of possession of a controlled substance (meth), a Class 5 felony, and possession of drug paraphernalia, a Class 2 misdemeanor. Kleinsasser applied for a court-appointed attorney. Her case was continued for three weeks.
* Jazlyn Anderson, 24, of Mitchell, appeared in court to face multiple drug-related. These included possession of a controlled substance (THC wax), a Class 6 felony, possession of controlled substances (Clonazepam and marijuana wax), Class 5 felonies. Additional charges included possession of drug paraphernalia, a Class 2 misdemeanor, and possession of 2 ounces of marijuana, a Class 1 misdemeanor. Anderson applied for a court-appointed attorney. Her case was continued for three weeks.
* Elliott Star Iron Shell, 34, of Mitchell, pleaded not guilty to a fifth or subsequent offense of domestic abuse/simple assault, a Class 4 felony, and interference with emergency communications, a Class 1 misdemeanor. A jury trial is scheduled for March.
* Robert Stoltz, 58, of Mount Vernon, pleaded not guilty to a domestic abuse/simple assault charge, a Class 1 misdemeanor. A jury trial is scheduled for March.
* Arvin Aaberg, 55, of Sioux Falls, pleaded guilty to unauthorized distribution of methamphetamine, originally a Class 3 felony but due to Aaberg’s status as a habitual offender, the charge was elevated to a Class 1 felony. The court ordered a pre-sentencing report and Aaberg is scheduled for sentencing in January. As part of a plea agreement, a Class 5 felony charge of possession of a controlled substance (meth) was dismissed.
* Allen Thomson, 32, of Mitchell, pleaded guilty to aggravated eluding, a Class 6 felony. Thomson will be sentenced in January. As part of a plea agreement, a Class 1 misdemeanor charge of obstructing police was dismissed.
* Craig Maas, 41, of Mitchell, was sentenced for distribution of methamphetamine, a Class 4 felony. Maas was sentenced to 10 years in prison, with two years suspended and was credited for 91 days served.
* Matthew Sherman, 35, of Chamberlain, appeared in court for a motions hearing. Sherman is facing charges of possession of a controlled substance, a Class 5 felony, and unauthorized manufacturing/distribution of methamphetamine, a Class 3 felony. Sherman previously pleaded not guilty to the charges and a jury trial is scheduled for February.
* Tyler Brinkman, 25, of Letcher, pleaded not guilty to possession of drug paraphernalia, a Class 2 misdemeanor, and possession of a controlled substance (cocaine), a Class 5 felony. A jury trial is scheduled for March.
* Elisa Hampton, 56, of Tacoma, Washington, pleaded not guilty to distribution of drugs (psilocybin mushrooms and hashish oil), a Class 4 felony, and possession of controlled substances (psilocybin mushrooms and hashish oil), a Class 5 felony. A jury trial is scheduled for March.
* Richard Dehmer, 50, of Fairmont, Minnesota, failed to appear in court on drug-related charges. Dehmer is charged with possession of drug paraphernalia, a Class 2 misdemeanor, and possession of a controlled substance (meth). The court issued a bench warrant for his arrest.
* Jordan Dobesh, 23, of White Lake, pleaded not guilty to several charges, including failure to maintain financial responsibility and hit and run, both Class 2 misdemeanors; a hit and run causing property damage, DUI and criminal entry of a vehicle, all Class 1 misdemeanors, as well as first-degree burglary, a Class 2 felony. A jury trial is scheduled for March.
* Kyle Erickson, 34, of Sioux Falls, pleaded not guilty to several charges, including intentional damage to property amounting to less than $400, a Class 2 misdemeanor; attempted grand theft in the amount of $1,000-$2,500 and obstructing police, both Class 1 misdemeanors; as well as third-degree burglary, a Class 5 felony. A jury trial is scheduled for March.
* Matthew Nunez, 31, of Mitchell, pleaded not guilty to several charges, including resisting arrest, failure to maintain financial responsibility, and possession of drug paraphernalia, all Class 2 misdemeanors; obstructing police, first-offense DUI, and hit and run, all Class 1 misdemeanors; as well as simple assault against a law enforcement officer, a Class 6 felony. A jury trial is scheduled for March.
* Jordan Scheel, 33, of Mitchell, was sentenced for possession of methamphetamine and third-degree burglary, both Class 5 felonies. For the possession charge, Scheel received a five-year prison sentence with all time suspended and was credited for six days served. He was also ordered to pay a $500 fine. For the burglary charge, he received another five-year prison sentence, also with all time suspended, along with a $500 fine and $1,000 in restitution.
* John Hofer, 53, of Renner, was sentenced for possession of a controlled substance (meth), a Class 5 felony. Hofer was sentenced to five years in prison with two years suspended, and received credit for 36 days served.
* Felix Rodriguez, 39, of Mitchell, appeared in court for a motions hearing, during which a stipulation was filed. Rodriguez is facing several drug-related charges, including possession of drug paraphernalia, a Class 2 misdemeanor; possession of Tramadol, a Class 6 felony and possession of meth, a Class 5 felony.
* Wendy Knapp, 49, of Chamberlain, pleaded not guilty to possession of drug paraphernalia, a Class 2 misdemeanor, and possession of a controlled substance (meth), a Class 5 felony. A jury trial is scheduled for March.
* Matthew Weddell, 44, of Mitchell, appeared in court to request a furlough for inpatient treatment. The court granted the furlough. Weddell is facing a grand theft charge involving an amount between $2,500 and $5,000. He pleaded guilty back in November, and a jury trial is scheduled for March.
* Jerome Sitting Crow, 39, of Rapid City, admitted to a probation violation. He was serving probation for a possession of a controlled substance charge. He was sentenced to 300 days in county jail with credit for 18 days served.
* Derek Schleder, 47, of Mitchell, appeared in court for a probation violation and new charges of possession of a controlled substance (meth), a Class 5 felony. The case was continued until January.
* Aria Uthe, 27, of Sioux Falls, denied a probation violation. Uthe was serving probation for possession of a controlled substance, a Class 5 felony. Uthe will reappear in court in January for a probation violation advisory/dispositional hearing.
* Mitchell Old Lodge, 31, of Chamberlain, pleaded not guilty to grand theft involving an amount between $1,000 and $2,500, a Class 6 felony. Old Lodge allegedly stole merchandise belonging to County Fair. A jury trial is scheduled for March.
* Jolene Vaughn, 20, of Mitchell, pleaded not guilty to attempted first degree robbery, a Class 3 felony, and first-degree burglary, a Class 2 felony. A jury trial is scheduled for March.
* Tyler Fernau, 35, of Mitchell, pleaded not guilty to possession of a controlled substance (meth), a Class 5 felony, and intentional damage to property totaling between $1,000 and $2,500. According to court documents, Fernau allegedly caused $1,300 damage to an apartment door. A jury trial is scheduled for March.
