Longtime local bar, restaurant sued over alleged drunk driving death

A popular Wichita Falls restaurant and bar business has been sued in connection with the death of a man police say was killed by a drunk driver.

P-2 The Deuce, LLC, P-2 The Deuce Realty, LLC dba The Warehouse, were sued Nov. 19 by survivors of Edgar Alarcon, who was killed on March 15 when his pickup was struck by another pickup driven by Dakota Joseph Phillips at the intersection of Kell West Boulevard and Holliday Street.

Phillips, 20 at the time of the collision, is also named as a defendant in the suit filed in 78th District Court.

The plaintiffs, who seek damages over $1 million, allege Phillips had spent the evening drinking at The Warehouse, an establishment owned by P-2 The Deuce.  Both establishments are located in the 1400 block of Lamar Ave.

“Phillips was served numerous alcoholic drinks by employees of P-2 The Deuce Realty, LLC and P-2 The Deuce, LLC, despite that he was underage and overly intoxicated,” the plaintiffs claim.

The plaintiffs contend they have suffered mental anguish, loss of companionship and financial loss because of Alarcon’s death.

The lawsuit was filed by Alarcon’s family members, Laura Luna Olivas, Melissa Alarcon Luna and Laura Alarcon Olivas.

Phillips was jailed on intoxication manslaughter charges on May 17 and was released the following day on $25,000 bail, according to Wichita County Jail records.

The second degree felony is punishable by up to 20 years in prison. Anyone accused of a crime is presumed innocent unless convicted in a court of law.

A search Friday of Wichita County court records did not turn up a grand jury indictment for the manslaughter charge.
