Man sentenced to 11 years prison on assault, firearm charges

Dec. 10—LIMA — A Lima man was sentenced to a minimum of 11 years in prison Tuesday in the Allen County Common Pleas Court on assault and firearm charges after pleading guilty to the charges last month.

The sentence was agreed upon when Dewayne Carter Jr., 43, pleaded guilty to third-degree felonies of attempted assault, illegal possession of a firearm in a liquor permit premises and having weapons while under disability along with a second-degree felonious assault charge with a three-year firearm specification.

Judge Jeffrey Reed previously explained Carter would be eligible to apply for judicial release after 10 years are served.

The charges stem from two incidents, one on Jan. 12 and one on April 30.

According to court documents, on Jan. 12, Lima police went to the Bite & Buzz parking lot at 701 S. Main St. on a report of a shooting. Police found a male in the parking lot with non-life-threatening gunshot wounds on the right side of his face and his inner right thigh and a broken jaw. Carter had fled the scene and was not immediately located. The victim said he knew Carter, adding that the altercation centered around Carter’s wife.

Carter said before sentencing Tuesday that he was under the influence when both incidents occurred.

His record in the Allen County Common Pleas Court shows he previously faced charges of cocaine possession and trafficking, failure to comply with the order or signal of a police officer and having weapons under disability.
