Jan. 15—A man who was charged after he reportedly pointed a gun at two police officers and was shot has been sentenced to prison and a fine.
Eric Tyrone Grady Sr., 46, of Dayton, was sentenced by Montgomery County Common Pleas Judge Elizabeth Ellis to a total of two and a half years in prison after Grady plead guilty to two charges of having weapons under disability and one count of possession of cocaine with a one-year firearm specification. He received credit for 108 days already spent in confinement.
Grady was also ordered to pay a fine of $7,500. Once released he may face up to two years of parole.
At the time of writing, he was not in the Montgomery County Jail.
Grady was charged connected to a shooting in the 900 block of Custer Place on Aug. 23, 2024.
Dayton police were called twice to the DeSoto Bass apartment complex on a report of a man with a gun.
Two officers responded around 10:50 p.m. but didn’t find the man, telling witnesses to call 911 if he came back, Dayton Police Chief Kamran Afzal said previously during a media briefing.
The same officers were dispatched again at 11:36 p.m. when the man returned. They arrived at 11:37 p.m., and shortly after video from one officer’s body-worn camera appeared to show the man, later identified as Grady, not comply with police commands to drop his weapon.
Afzal said, “Both officers discharged their firearms at the suspect after the suspect raised the firearm in their direction.” One officer fired once and the second fired three times, the chief said.
The officers then rendered medical aid, and medics took Grady to a local hospital with reportedly non-life-threatening wounds.
Police recovered two handguns at the scene. One that was reported stolen in Dayton had 46 live rounds in a drum-style extended magazine. The second had 12 live rounds in an extended magazine, Afzal said.
The officers were put on paid administrative leave in accordance with department policy, and a grand jury declined to indict them in the shooting.
