Two indicted on felony charges in Delaware County

Delaware County’s district attorney said two people were indicted on multiple drug charges, and one of them faces felony weapons charges, as well..

According to a news release from Shawn J. Smith, a grand jury returned a twelve-count indictment against Nicholas J. Cartelli, 47, of Otego, and Taylor J. Church, 38, of Bainbridge on Jan. 7.

Count One accuses Cartelli and Church of third-degree criminal possession of a controlled substance, a Class B felony. It is alleged they possessed heroin, with intent to sell it, in the town of Sidney on Jan. 3.

Count Two accuses the pair of fourth-degree criminal possession of a controlled substance, a Class C felony. It is alleged that they possessed more than 1/8 ounce of heroin in the town of Sidney the same day.

Count Three accuses the pair of seventh-degree criminal possession of a controlled substance, a Class A misdemeanor. It is alleged that they possessed buprenorphine, also in Sidney on the same day.

Count Four accuses Cartelli of third-degree criminal possession of a controlled substance. It is alleged he possessed more than 1/8 ounce of methamphetamine the same day in Sidney, and that he intended to sell it.

Count Five of the Indictment accuses both Cartelli and Church of fifth-degree criminal possession of a controlled substance, a Class D felony. It is alleged that they possessed more than 500 milligrams of cocaine in Sidney on the same day.

Counts Six and Seven accuse both Cartelli and Church of second-degree using drug paraphernalia, a Class A misdemeanor. It is alleged that they were found in possession of plastic baggies and other material suitable for packaging individual quantifies of illegal narcotics. It is also alleged that they possessed scales with the intention of using them for unlawfully packaging and dispensing a narcotic drug in Sidney the same day.

Count Eight accuses Cartelli of second-degree criminal possession of a forged instrument, a Class D felony. It is alleged that he was operating a motor vehicle with a forged inspection sticker in Sidney the same day.

No date or location was listed for the following indictments.

Count Nine accuses Cartelli of second-degree criminal possession of a weapon, a Class C violent felony. It is alleged that he possessed a loaded .25 caliber handgun, with the intention of using it unlawfully.

Count Ten accuses Cartelli of second-degree criminal possession of a weapon, Class C violent felony. It is alleged that he possessed a loaded semi-automatic rifle that had been sawed off, with the intention of using it against another person.

Counts Eleven and Twelve accuse Cartelli of additional felonies related to possession of those same firearms.
